Vehicle Rental Agreement

This Vehicle Rental Agreement ("Agreement") is entered into between Summit Drive LLC, a Colorado limited liability company ("Summit Drive"), and the individual identified in the reservation confirmation ("Renter"). By accepting delivery of a vehicle, Renter agrees to all terms of this Agreement.
1. Vehicle Use
Renter agrees to operate the vehicle solely for lawful purposes within the continental United States. The vehicle shall not be used for commercial transportation of passengers for hire, participation in racing or competitive driving events, off-road operation (except on unpaved roads passable by a standard passenger vehicle), or any illegal activity.
Only the approved Renter listed on this Agreement and any additional authorized drivers approved in writing by Summit Drive may operate the vehicle. Unauthorized use of the vehicle voids all liability protections and may result in immediate termination of the rental.
2. Fuel Policy
The vehicle will be delivered with a full tank of fuel. Renter is responsible for returning the vehicle with a full tank. If the vehicle is returned with less than a full tank, Summit Drive will charge the Renter a refueling fee of $12/gallon plus a $35 service charge, billed to the card on file.
3. Mileage
Each rental includes 250 miles per day. Excess mileage is billed at $0.45 per mile and charged automatically to the card on file at the close of the rental period. Mileage is recorded by odometer at pickup and return.
Security Deposit: A refundable security deposit of $1,000 is held at pickup via credit card authorization (not a charge). This hold is released within 5 business days of vehicle return, pending inspection for damage, fuel, and excess mileage.
4. Age and Licensing Requirements
Renter must be a minimum of 25 years of age and hold a valid driver's license issued by a U.S. state or Canadian province. International renters must present a valid International Driving Permit alongside their foreign license. Summit Drive reserves the right to decline any rental at its discretion.
5. Geographic Restrictions
The vehicle may not be transported outside the continental United States. Colorado, Utah, Wyoming, and New Mexico are approved without restriction. All other states require advance notice.

Liability & Insurance

Summit Drive LLC maintains commercial auto insurance on all fleet vehicles. This policy provides primary coverage during all authorized rental periods. The following outlines the coverage structure and Renter responsibilities.
Coverage Included
- Third-party liability coverage up to $500,000 per occurrence
- Uninsured/underinsured motorist protection
- Roadside assistance and towing within the continental U.S.
- Comprehensive and collision coverage (subject to deductible as outlined below)
Collision Damage Responsibility
In the event of a collision or vehicle damage during the rental period, Renter is responsible for a damage deductible of $2,500 regardless of fault. This deductible may be reduced or waived if Renter's personal auto insurance or credit card travel benefits provide collision damage waiver (CDW) coverage. Renter is encouraged to verify their coverage prior to rental.
Renter's personal auto insurance policy may extend coverage to rental vehicles. Many premium credit cards include rental car CDW as a cardholder benefit. Summit Drive recommends verifying your existing coverage before purchasing supplemental coverage.
Theft Liability
In the event of theft, Renter is responsible for the $2,500 deductible. Theft must be reported to local law enforcement and a police report provided to Summit Drive within 24 hours of discovery. Failure to report theft may result in Renter bearing full replacement cost.
Exclusions
Coverage does not apply to: damage resulting from unauthorized operation; damage caused by driving under the influence of alcohol or controlled substances; interior damage caused by negligence; damage to tires, rims, or undercarriage from off-road operation; or personal belongings left in the vehicle.

Damage Policy

Pre-Rental Inspection
Summit Drive conducts a documented inspection of each vehicle prior to every rental, including photographs of all body panels, interior, wheels, and glass. Renter is invited to review and countersign the inspection report at pickup. Any pre-existing damage will be noted. Renter acceptance of the vehicle constitutes agreement that no other damage exists at the time of pickup.
Return Inspection
A return inspection is conducted immediately upon vehicle return. If damage is identified that was not present at pickup, Summit Drive will document the damage and contact the Renter within 48 hours with a written assessment and repair estimate.
Damage Assessment & Billing
Minor cosmetic damage (light scratches, small dings) is assessed against a standardized damage matrix provided upon request. Significant damage is assessed by a licensed body shop at Summit Drive's discretion. Renter will receive an itemized repair invoice. The $2,500 deductible applies per incident, not per damage item.
Interior Damage
Renter is responsible for any interior damage beyond normal use. Excessive soiling requiring professional detailing beyond standard cleaning is billed at actual cost. Damage from smoking, pet transport (without prior approval), or spills that cannot be remedied by standard detailing will be assessed at full remediation cost, up to $800.
Summit Drive vehicles are delivered fully detailed. Please treat the vehicle with the same care you would your own. It helps us keep rates competitive and vehicles pristine for every renter.

Cancellation Policy

Summit Drive understands that travel plans change. Our cancellation policy is designed to be fair while reflecting the reality of holding premium vehicles off-market.
Standard Cancellation Schedule
- 14+ days before pickup: Full refund, no fee
- 7–13 days before pickup: 50% refund of rental total
- 3–6 days before pickup: 25% refund of rental total
- Less than 72 hours: No refund
Peak Season (November – April)
Due to elevated demand during ski season, cancellations during peak season are subject to a stricter schedule. Full refunds are available 21+ days before pickup. Within 21 days: 50% refund for 14–20 days; 25% refund for 7–13 days; no refund within 7 days.
How to Cancel
To cancel a reservation, contact Summit Drive directly via email with your reservation confirmation number. Cancellation is effective upon written confirmation from Summit Drive. Refunds are processed to the original payment method within 5–7 business days.
Summit Drive recommends travelers purchase trip cancellation insurance, particularly for peak-season bookings. Many travel credit cards and standalone travel policies cover rental car cancellation fees.
No-Show Policy
Failure to pick up the vehicle at the confirmed time without prior notice constitutes a no-show and will result in forfeiture of the full rental amount. If Renter expects to be delayed, please contact Summit Drive immediately so we can accommodate.
Terms & Conditions

1. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising from this Agreement shall be resolved in the courts of Jefferson County, Colorado.
2. Limitation of Liability
Summit Drive's total liability to Renter for any claim arising from this Agreement shall not exceed the total rental fees paid by Renter for the rental period in question. Summit Drive is not liable for consequential, incidental, or punitive damages of any kind.
3. Indemnification
Renter agrees to indemnify and hold harmless Summit Drive LLC, its members, managers, employees, and agents from and against any claims, damages, losses, and expenses arising from Renter's use of the vehicle, including but not limited to third-party claims, traffic violations, parking citations, and toll charges incurred during the rental period.
4. Traffic Violations & Tolls
Renter is solely responsible for all traffic citations, parking violations, toll charges, and other fees incurred during the rental period. Summit Drive may pass through to Renter any fines or administrative fees charged to Summit Drive as a result of Renter's violations, plus a $35 administrative processing fee per incident.
5. Privacy
Summit Drive collects personal information including name, contact information, and driver's license data for the sole purpose of fulfilling rental agreements and legal compliance. This information is not sold to third parties.
6. Modifications
Summit Drive reserves the right to modify these Terms at any time. The version in effect at the time of reservation confirmation governs the rental. Renters will be notified of material changes via email.
7. Severability
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
